Vanessa Walker's Principles in Power: Latin America and the Politics of U. S. Human Rights Diplomacy (Cornell University Press, 2020) explores the relationship between policy makers and nongovernment advocates in Latin America and the United States government in order to explain the rise of anti-interventionist human rights policies uniquely critical of U.S. power during the Cold War. Walker shows that the new human rights policies of the 1970s were based on a complex dynamic of domestic and foreign considerations that was rife with tensions between the seats of power in the United States and Latin America, and the growing activist movement that sought to reform them. By addressing the development of U.S. diplomacy and politics alongside that of activist networks, especially in Chile and Argentina, Walker shows that Latin America was central to the policy assumptions that shaped the Carter administration's foreign policy agenda. The coup that ousted the socialist president of Chile, Salvador Allende, sparked new human rights advocacy as a direct result of U.S. policies that supported authoritarian regimes in the name of Cold War security interests. From 1973 onward, the attention of Washington and capitals around the globe turned to Latin America as the testing ground for the viability of a new paradigm for U.S. power. This approach, oriented around human rights, required collaboration among activists and state officials in places as diverse as Buenos Aires, Santiago, and Washington, DC. Principles in Power tells the complicated story of the potentials and limits of partnership between government and nongovernment actors. Analyzing how different groups deployed human rights language to reform domestic and international power, Walker explores the multiple and often conflicting purposes of U.S. human rights policy.

In his most recent book, Human Rights in a Divided World: Catholicism as a Living Tradition (Georgetown UP, 2024), Jesuit scholar and Georgetown professor, Fr David Hollenbach explains the Judeo-Christian roots of our concept of human rights and the contributions of secular institutions like the United Nations Universal Declaration of Human Rights (1948). He explains further when it is right for a country to intervene in the affairs of its neighbors, codified by the UN in 2005 as the Responsibility to Protect in answer to the 1994 Rwandan Genocide that gave lie to the world’s promise of “never again” after the horrors of the Holocaust. He contrasts the doctrine of R2P with the tragic case of a homicide in Kew Gardens in 1964 where 38 witnesses, all law-abiding “good people,” failed to intervene because they assumed someone else would do it. “Am I my brother’s keeper?” Cain asked God (Gen 4:9). “Who is my neighbor?” The lawyer asked Jesus (Lk 10:29), to which Our Lord told the parable of the Good Samaritan. Perhaps these questions are a little more complicated between sovereign nations than they are between travelers on a dangerous road, but Fr. David guides us through the Catholic Church’s moral teachings, the principles of proportionality and of just war, and the ability and desire to do something even when we can’t do everything. This book poses the question: How relevant is the concept of war today? Professor Andrew Clapham of the Graduate Institute of International and Development Studies in Geneva examines how notions about war continue to influence how we conceive rights and obligations in national and international law. It considers the role international law plays in limiting what is forbidden and what is legitimated in times of war or armed conflict. The book highlights how, even though war has been outlawed and should be finished as an institutions, sates nevertheless continue to claim that they can wage necessary wars of self-defence, engage in lawful killings in war, imprison law-of-war detainees, and attack objects that are said to be part of a war-sustaining economy. Professor Clapham argues that, while there is general agreement that war has been abolished as a legal institution for settling disputes, the time has come to admit that the belligerent rights that once accompanied states at war are no longer available. In other words, simply claiming to be in a war or an armed conflict does not grant anyone a licence to kill people, destroy things, and acquire other people’s property or territory. In this podcast, we begin by exploring Professor Clapham’s motivation for writing the book and the central arguments challenging traditional ideas of war, law, and state power. We discuss how historical, and outdated, ideas of ‘prize’ or war booty continue to influence modern conflict, and explore how rhetorical usages of the words ‘war’ and ‘armed conflict’ exert a particular influence on populations and even on the soldiers themselves. Professor Clapham argues that human rights law should play a bigger role in limiting actions of states in armed conflict, and looks to the future legal challenges posed by cyber warfare, drones and AI / autonomous weapons. We also touch on accountability for war crimes and other international crimes, both at the level of international state responsibility as seen at the International Court of Justice, and at the individual criminal liability as seen in the International Criminal Court. Everyday items found at the sites of atrocities possess a striking emotional force. Victims’ garments, broken glasses, wallets, shoes, and other such personal property that are recovered from places of death including concentration camps, mass graves, and prisons have become staples of memorial museums, exhibited to the public as material testimony in order to evoke sympathy and promote human rights. How do these objects take on such power, and what are the benefits and pitfalls of deploying them for political purposes? A Victim's Shoe, a Broken Watch, and Marbles: Desire Objects and Human Rights (Columbia University Press, 2025) by Dr. Lea David examines how artifacts of atrocities circulate and, in so doing, sheds new light on the institutions and social processes that shape collective memory of human rights abuses. Dr. Lea David traces the journeys of what she terms “desire objects”: their rediscovery at the locations of mass atrocities, their use in forensic and legal procedures, their return to the homes of grieving families, their appearance in public spaces such as museums and exhibitions, and their role in political protests. She critically investigates the logic that shapes why and how desire objects gain symbolic power and political significance, showing when and under what circumstances they are used to promote particular worldviews and narratives. Featuring both novel theoretical methods and keen empirical analysis, this book offers important insights into the shortcomings of common assumptions about human rights. This interview was conducted by Dr. Miranda Melcher whose new book focuses on post-conflict military integration, understanding treaty negotiation and implementation in civil war contexts, with qualitative analysis of the Angolan and Mozambican civil wars. Mass violence comes not only from states, but also from people. By analyzing mass violence as social interaction through survivor accounts and other sources, Conditions of Violence (de Gruyter, 2024) presents understudied agents, aims and practices of direct violence and ways of action of those under persecution. Sound history – examining the noises of mass violence and persecution – is particularly telling about such practices. This volume shows that violence can become socially hegemonic, and some people claim a freedom to kill as a political right. To scrutinize indirect violence, which is often imperialist in character and claims many victims, the book proposes the concept of conditions of violence. These conditions are produced by definable groups of actors and foreseeably harm definable groups (which differs from the anonymous and static ‘structural violence’). This is exemplified in a case study concerning famines in World War II and another on COVID-19 as mass violence. Justice and Restitution in Post-Nazi Romania explores the hopes, struggles and disappointments of Jewish communities in Romania seeking to rebuild their lives after the Holocaust. Focusing on the efforts of survivors to recuperate rights and property, Stefan Cristian Ionescu demonstrates how the early transitional government enabled short term restitution. However, from 1948, the consolidated communist regime implemented nationalizations which dispossessed many citizens. Jewish communities were disproportionality affected, and real estate and many businesses were lost once again. Drawing on archival sources from government documentation to diaries and newspaper reports, Justice and Restitution in Post-Nazi Romania: Rebuilding Jewish Lives and Communities, 1944-1950 (Cambridge UP, 2024) explores both the early success and later reversal of restitution policies. Violence has only increased in Mexico since 2000: 23,000 murders were recorded in 2016, and 29,168 in 2017. The abundance of laws and constitutional amendments that have cropped up in response are mirrored in Mexico's fragmented cultural production of the same period. Contemporary Mexican literature grapples with this splintered reality through non-linear stories from multiple perspectives, often told through shifts in time. The novels, such as Jorge Volpi's Una novela criminal [ A Novel Crime ] (2018) and Julián Herbert's La casa del dolor ajeno [ The House of the Pain of Others ] (2015) take multiple perspectives and follow non-linear plotlines; other examples, such as the very short stories in ¡Basta! 100 mujeres contra la violencia de género [ Enough! 100 Women against Gender-Based Violence ] (2013), present perspectives from multiple authors. Few scholars compare cultural production and legal texts in situations like Mexico, where extreme violence coexists with a high number of human rights laws. Unlawful Violence: Mexican Law and Cultural Production (Vanderbilt UP, 2022) measures fictional accounts of human rights against new laws that include constitutional amendments to reform legal proceedings, laws that protect children, laws that condemn violence against women, and laws that protect migrants and Indigenous peoples. Based on nearly a decade of research in some of the world’s most challenging conflict zones, Edges of Care offers a profound account of abandoned lives and lands, and how they endure and sometimes thrive once left to fend for themselves. Leshem interrogates no man’s land as a site of radical uncaring: abandoned by a sovereign power in a relinquishment of responsibility for the space or anyone inside it. To understand the ramifications of such uncaring, Leshem takes readers through a diverse series of abandoned places, including areas in Palestine, Syria, Colombia, Sudan, and Cyprus. At the intersection of politics, law, and culture, this book documents the visionary emergence of the international Indigenous movement, detailing its challenges and achievements, including the historic recognition of Indigenous rights through the adoption of the UN Declaration on the Rights of Indigenous Peoples in 2007. The winning by Indigenous Peoples of an unprecedented kind and degree of international participation – especially at the United Nations, an institution centered on states – meant overcoming enormous institutional and political resistance. The book shows how this participation became an increasingly assertive self-expression and even an exercise of self-determination by which Indigenous Peoples could both benefit from and contribute to the international community overall – now, crucially, by sharing their knowledge about climate change, their approaches to development and well-being, and their struggles against the impact of extractive industries on their lands and resources.
