'In an affidavit to the Supreme Court, which is reviewing petitions challenging the constitutionality of the marital rape exception under Section 375 of the Indian Penal Code, the Union Ministry of Home Affairs has argued that marital rape should not be criminalised. The affidavit asserted that labelling marital rape a criminal offence was “excessively harsh” and could destabilise the institution of marriage.
