Episode 5 - The Essence of Louisianas Exonerations
Manage episode 434472622 series 3554240
We continue with the legal ruling on the DA's and Prosecutors appeal of the jury's verdict against them in the civil suit for the wrongful conviction of JT.
JT's lawyers found a way to sue the Prosecutors and the DA, which most lawyers never attempt.
The public must keep in mind that it is the Prosecutors from the DA's office that puts the case together and presents it to the jury so, when they get it wrong it makes sense that the public and the victims would assume there will be a remedy against those responsible for pursuing such a case.
This was a civil suit and if you listen very closely to the Appeals Court ruling, you'll learn about all the ins and out on the legal theory that JT's lawyers pursued and the capacities the defendants ( DA and Prosecutors ) were sued in.
The people that usually help free the innocent, spend days, years, months reading over transcripts and re-investigating the case to find a way to get the case back in front of a judge.
It's usually those at the Innocence Projects, Journalism Students, Journalists and Investigators that devote so much time to free the exonerated.
At some point, if we are to take measure as to how far we've advanced since all the fights for civil and human rights gains ( on paper ), we'll need to take at a look at how it is these cases happened and at accountability for the injustice and that justice can't continue to be limited at the expense of taxpayers.
